Holtek product Delivery, Warranty, and Return Policies.

Delivery policy:

  1.  All deliveries shall be made and delivered to Buyer F.O.B point of shipment.
  2.  Title to and risk of loss shall pass to Buyer on Seller's placing same in the custody of a carrier for shipment to Buyer.
  3.  Within thirty (30) days of receipt by Buyer of any delivery, Buyer shall inspect same and immediately notify Seller of any defects in the Products. Failure to so notify Seller in writing of any defects within thirty (30) days of receipt shall constitute conclusive proof that the Products were received without defects.
  4.  In any event Seller shall not be responsible for any damage caused to the Products during shipment. It is the sole responsibility of Buyer to file any appropriate claims with the carrier for reimbursement.

Warranty policy:

Seller sells the Products with the intent that they are free of defects in manufacture and workmanship at the time of shipment. Seller warrants that each of its Products will be free of defects in material and workmanship under normal use and service. However, the obligation of Seller under this warranty shall be limited to the requirement that it make good at Seller’s place of business any part or parts which are returned to Seller within one (1) year from the date of delivery to Buyer. Seller does not warrant any Product which is or has been the subject of misuse, negligence, accident, repair or alteration which, in the judgment of Seller, affects the Product's stability or reliability. Seller’s sole obligation for Products failing to comply with the warranty set forth above shall be, at Seller’s discretion, to either replace the nonconforming Product or issue Buyer credit for the purchase price of the nonconforming Product where, within the applicable warranty period and in accordance to

Holtek’s return procedures:

  1. Seller received Buyer request for an Return Merchandise Authorization (RMA) for the return of nonconforming Product;
  2.  Where Seller has issued Buyer a RMA, Buyer has returned the nonconforming Product to Seller in accordance with Holtek’s return procedure. Such return of nonconforming Product to Holtek and/or Seller must be made with transportation charges prepaid by Buyer.
  3.  Holtek has determined that the Product is nonconforming and such nonconformity is not the result of improper installation, repair or other misuse.

Return policy/procedures:

1) There is no cancellation or return on masked, pre-programmed and/or custom products. Said Products are NCNR (Non-cancellable, non-returnable) upon order confirmation by Seller.

2) Buyer may return nonconforming Products under warranty as stipulated in Warranty policy only with Seller’s consent and in accordance with Holtek’s return procedures. Prior to returning of nonconforming Product under warranty, Buyer must request a Return Merchandise Authorization (RMA) from Seller. Seller shall send Buyer an e-mail with RMA number. Upon Seller’s confirmation of Buyer’s right to return, Seller at its discretion either: (a) provide Buyer with authorization to scrap the product and either issue Buyer a credit for the purchase price of the Product or ship Buyer replacement at its own expense as soon as practicable; or (b) issue an RMA requiring Buyer to return the nonconforming product freight prepaid in accordance to Seller’s instructions in good condition and without alteration within fifteen (15) days following the RMA issue date. All returns must be accompanied by the Seller’s sales order number or invoice number, the RMA number and an explanation for the reason of return. Products returned must agree exactly with the part numbers and quantities authorized for return in the RMA. Following Holtek’s evaluation of the returned Product, Seller will notify Buyer via e-mail whether the return has been approved or rejected. Seller shall at its discretion either issue Buyer a credit for the purchase price of the Product or ship Buyer replacement Product for approved returns. For rejected return, Buyer must notify Seller of its preferred handling for the return or scrap of the product. Should Buyer fail to notify Seller within seven (7) days of Seller rejection notice, Seller will scrap the product.
